Terms of use
Terms of use
The agreement between you and us when you use Accessible Index.
The agreement
These terms are an agreement between you and Dynamosys Inc., a Virginia corporation trading as Accessible Index (“we”). By using accessibleindex.com you accept them. Our privacy policy explains how we handle personal information.
You must be 16 or older to use Accessible Index. If you use it for an organization, you confirm you may accept these terms for it.
What our results are
Accessible Index runs automated accessibility checks on public web pages and publishes an index of government websites. Results describe what our scanner found on the date shown. Automated checks find many problems but not all, and can be wrong.
Our results are not legal advice, and not a certification that any site meets the ADA, Section 508, Section 504, WCAG or any other law or standard.
Checking a site
You may check any public website. Our scanner reads public pages as a visitor would, follows each site’s robots.txt, and never signs in, submits a form or gets around a block. You are responsible for how you use what the service tells you.
You agree not to:
- use the service to strain or attack a site, or to break the law;
- get around our limits on how many checks one visitor can start, or run checks by script or in bulk;
- build datasets or lists of sites from our results, except as “Using what we publish” allows;
- send us other people’s personal information, in a form or in a file, except your own work details.
We may limit, suspend or block any use that breaks these terms or puts the service, or a site we check, at risk.
Claiming a government’s page
Only the staff of a government can claim its page, with an email address on the domain of the website we check. By claiming, you confirm you work for it and may speak for it on its website. A scan you start from the claimed page is published on the public page like our regular check, marked as checked at the government’s request.
The page’s status is chosen from a fixed set, with no text of your own, and is published as the government’s, never under your name. Set only a status that is true. It shows for six months unless you confirm it, and we may reset a status that isn’t true.
Using what we publish
You may quote, link to and share our pages and results, in news, research, advocacy or anywhere else, with credit to Accessible Index and the date of the result.
You may not copy the index in bulk, scrape it, or reuse it in bulk for a commercial purpose, such as building lists of sites to sell to. Researchers can ask for access under a signed agreement.
Our content and others’
Our text, method, scores, design and logo are ours. Reports show screenshots of other websites as evidence for commentary on their accessibility; those sites’ owners keep their rights in them.
PDF checks and repair
The free PDF check reads your file in memory and keeps no copy. Only check documents you have the right to share. PDF repair is sold under its own PDF service terms, which you accept when you order.
Disputes and corrections
If you think a result is wrong, tell us through the dispute form. A person checks it against the evidence from that scan, and we date any correction.
If your use causes a claim
If someone brings a claim against us because you broke these terms or misused the service, you agree to cover our reasonable costs of it, lawyers’ fees included, to the extent the law allows.
No warranty
The service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows, including any warranty that results are complete or free of errors, or that the site will always be available.
Limits on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the service or reliance on its results. Our total liability to you for any claim is limited to what you paid us in the 12 months before the claim, or $100 if you paid us nothing.
Time to bring a claim
Where the law allows, any claim about the service must be brought within one year of when it arose, or it can no longer be brought.
Governing law
These terms are governed by the laws of the Commonwealth of Virginia. Any dispute about them is for the state or federal courts located in Virginia.
Changes to these terms
We may change these terms. We post any change here with a new date and, for a change that matters, at least 7 days before it applies. Using the site after a change applies means you accept it. We keep every earlier version, so we can always show which terms applied on a given date.
General
- If any part of these terms can’t be enforced, the rest still applies.
- These terms, with our privacy policy and, for PDF repair, its service terms, are the whole agreement between you and us about the service.
- If we don’t enforce a term at once, we haven’t given it up.
- You may not transfer your rights under these terms. We may transfer ours to a company that takes over Accessible Index, under the same terms.
